Agreement to Terms

Welcome to Athens Bike Rentals. These Terms and Conditions ("Terms") govern your use of our bike rental services and website located at athensbikerentals.in (the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Service.

These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and Athens Bike Rentals ("we," "us," or "our"). Please read these Terms carefully before renting a bike from us.

Eligibility Requirements

To rent a bike from Athens Bike Rentals, you must meet the following requirements:

  • Be at least 18 years of age
  • Possess a valid driver's license for the type of bike you wish to rent
  • Provide valid government-issued photo identification
  • Have the physical and mental capability to safely operate the bike
  • Not be under the influence of alcohol, drugs, or any substance that may impair your ability to ride safely
Important:

We reserve the right to refuse service to anyone who does not meet these requirements or who we believe may pose a safety risk to themselves or others.

Booking and Reservations

Making a Reservation

Reservations can be made through our website, by phone, or in person at our location in Trivandrum. All reservations are subject to bike availability.

Reservation Confirmation

Your reservation is confirmed only when you receive a confirmation email or message from us. We recommend booking in advance, especially during peak tourist seasons.

Cancellation Policy

  • More than 24 hours before pickup: Full refund
  • Less than 24 hours before pickup: 50% refund
  • No-show or same-day cancellation: No refund

Modifications

You may modify your reservation up to 24 hours before the scheduled pickup time, subject to availability. Changes made within 24 hours may incur additional charges.

Rental Rates and Payments

Pricing

Rental rates vary depending on the bike type, rental duration, and season. All prices are displayed in Indian Rupees (INR) and are subject to change without notice. Current rates are available on our website and at our rental location.

Payment Methods

We accept the following payment methods:

  • Credit and debit cards (Visa, Mastercard, RuPay)
  • UPI (Google Pay, PhonePe, Paytm, etc.)
  • Cash payments at our location

Security Deposit

A refundable security deposit may be required for certain bikes. The deposit amount varies based on the bike type and will be clearly communicated at the time of booking. The deposit will be refunded within 7 business days after the bike is returned in good condition.

Additional Charges

You may be charged additional fees for:

  • Late returns (hourly rate applies)
  • Excessive mileage (if applicable to your rental agreement)
  • Fuel charges (if bike is not returned with the agreed fuel level)
  • Cleaning fees (if bike is returned excessively dirty)
  • Damage or loss of bike or accessories
  • Traffic violations or fines incurred during the rental period

Bike Pickup and Return

Pickup

At the time of pickup, you must present:

  • Valid driver's license
  • Government-issued photo ID
  • Payment method for security deposit (if applicable)
  • Booking confirmation

You will be required to inspect the bike thoroughly before taking possession. Any existing damage must be documented at this time. A free safety helmet will be provided with every rental.

Return

Bikes must be returned to our location in Trivandrum at the agreed time. Currently, we do not offer drop-off at alternative locations. The bike must be returned in the same condition as when rented, with the agreed fuel level.

Late Returns

If you need to extend your rental period, you must contact us in advance. Late returns without prior approval will incur additional hourly charges. If the bike is more than 6 hours late without communication, we reserve the right to report it as stolen to local authorities.

Customer Responsibilities

As a renter, you agree to:

  • Operate the bike safely and in accordance with all traffic laws
  • Wear the provided helmet at all times while riding
  • Not allow anyone else to operate the bike unless authorized
  • Not use the bike for racing, competitions, or illegal activities
  • Not transport the bike outside of Kerala without written permission
  • Secure the bike with the provided lock when parked
  • Notify us immediately of any accidents, damage, or mechanical issues
  • Keep all rental documents with you during the rental period
  • Not modify or tamper with the bike in any way
  • Pay for any traffic fines or violations incurred during the rental period

Insurance and Liability

Basic Insurance

Basic third-party insurance is included with all rentals. This covers liability to third parties as required by Indian law. Additional comprehensive insurance covering theft and accidental damage is available for an extra fee.

Damage Responsibility

You are responsible for any damage to the bike during the rental period, including but not limited to:

  • Collision damage
  • Theft or loss (unless comprehensive insurance is purchased)
  • Damage due to negligence or misuse
  • Mechanical damage resulting from improper use
  • Loss of keys, accessories, or documents

Personal Injury

While we provide safety equipment and maintain our bikes in excellent condition, we are not liable for any personal injuries sustained during the rental period. We strongly recommend that customers have their own personal accident insurance.

Third-Party Claims

You are responsible for any claims made by third parties resulting from your use of the bike, including property damage or personal injury to others.

Accidents and Breakdowns

In Case of Accident

If you are involved in an accident, you must:

  1. Ensure your safety and the safety of others
  2. Contact local authorities if required
  3. Notify Athens Bike Rentals immediately
  4. Document the incident with photos if possible
  5. Obtain contact information from any other parties involved
  6. Do not admit fault or make any settlements without our approval
  7. Provide us with a written accident report within 24 hours

Mechanical Breakdowns

If the bike experiences mechanical issues not caused by misuse or negligence, contact us immediately. We will provide guidance or arrange for a replacement bike if necessary. Do not attempt to repair the bike yourself or have it repaired by unauthorized mechanics.

Prohibited Uses

The rented bike must not be used for:

  • Illegal purposes or activities
  • Racing, speed contests, or stunts
  • Commercial transportation or delivery services
  • Riding under the influence of alcohol or drugs
  • Carrying passengers beyond the bike's capacity
  • Towing or pushing other vehicles
  • Off-road riding (unless specifically permitted for that bike model)
  • Teaching others to ride
  • Subleasing or renting to others
  • Transporting hazardous materials
Violation Notice:

Any prohibited use may result in immediate termination of the rental agreement, forfeiture of the security deposit, and potential legal action.

Maintenance and Bike Condition

All our bikes undergo regular maintenance and safety checks. We ensure that every bike is in excellent working condition before rental. However, you must inspect the bike before accepting it and report any concerns immediately.

During the rental period, you are responsible for:

  • Checking tire pressure and fluid levels regularly
  • Keeping the bike clean and in good condition
  • Reporting any unusual sounds, vibrations, or performance issues
  • Not ignoring warning lights or indicators

Privacy and Data Protection

We collect and process your personal information in accordance with our Privacy Policy. By using our Service, you consent to such processing and warrant that all data provided by you is accurate. Please refer to our Privacy Policy for detailed information on how we handle your data.

Limitation of Liability

To the maximum extent permitted by law, Athens Bike Rentals shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, or business opportunities
  • Personal injury or death (except where caused by our gross negligence)
  • Loss or damage to personal belongings left in or on the bike
  • Delays or failures in performance due to circumstances beyond our control

Our total liability to you for any claims arising from the rental shall not exceed the total amount paid by you for that rental.

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Athens Bike Rentals and is protected by Indian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

Termination

We reserve the right to terminate your rental agreement immediately without refund if:

  • You breach any of these Terms and Conditions
  • You provided false information during booking
  • You use the bike in a prohibited manner
  • You are found to be under the influence of alcohol or drugs
  • The bike is used for illegal activities
  • We believe the bike or others are at risk

Upon termination, you must return the bike immediately to our location at your own expense.

Force Majeure

Athens Bike Rentals shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, government actions, pandemics, wars, or other emergencies. In such cases, we will make reasonable efforts to fulfill our obligations or provide suitable alternatives.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of our Service shall be subject to the exclusive jurisdiction of the courts in Thiruvananthapuram, Kerala, India.

Dispute Resolution

In the event of any dispute, claim, or controversy arising from these Terms, both parties agree to first attempt to resolve the matter through good faith negotiations. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue legal remedies in accordance with the Governing Law section.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy and any rental agreement you sign, constitute the entire agreement between you and Athens Bike Rentals regarding your use of our Service and supersede all prior agreements and understandings, whether written or oral.

Amendments

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Service after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
